MOBY - GENERAL TERMS GENERAL CONDITIONSThe term "passenger" is used to designate all persons who are being transported on the basis of these General Transport Terms and conditions for passengers and vehicles. The term "transport enterprise" and/or "company" is used to designate the MOBY S.p.A., Via Conservatorio, 17 - 20122 Milano - Italy (C.F. 4846130633 - P.I. 13301990159). The transport enterprise is obligated, in accordance with the aforementioned General Transport Terms and Conditions, to offer transport service. Through the ordering or the purchase of a corresponding ticket, each passenger explicitly declares himself/herself to be aware of these conditions and is obligated to maintain and accept these conditions in their entirety.1) TRANSPORT REGULATIONSThe transport contract between the transport enterprise and the passengers is subject to Italian Law, inasmuch as the travel conditions hereinafter are subject to no other regulations. The transport enterprise does not assume any liability for damage caused by strikes, by cancelled and/or late departures due to poor weather conditions, by technical or mechanical defects on the ship, by incidents which cannot be answered for by the transport enterprise, by quarantines, war or any form of Acts of God. The transport enterprise maintains the right to change port, departure and arrival times, conditions, and transport rates at any time. The arrival and departure times have been calculated on the basis of the distances to the individual ports and due to good weather conditions. The transport enterprise is not to be held liable for any delays caused by port operations. The planned ship duty can be altered by the transport enterprise without having to give due cause. Please take a valid prospectus with you, as, among others, important telephone numbers are given in the prospectus.2) VALIDITY OF THE TICKETThe ticket is issued under a name, is non- transferable, and is valid for only those crossings specified on the ticket. The passenger is to keep the ticket and present it on request of an officer or a representative of the transport enterprise. Should the individual not be in possession of a valid ticket, twice the regular ticket amount will be charged and the individual may be liable to pay for damages. Acknowledgements from travel agencies for crossings in the form of a letter cannot be accepted. For incorrect information on the number of persons, vehicles, etc., the difference in amounts is to be paid immediately. When incorrect information on lengths and heights are given, one may be placed in a waiting list and embarkation refused. Open date tickets cannot be issued. For bookings performed in Italy the Italian travel conditions apply.3) CANCELLATIONS / REIMBURSEMENTSCancellations must be submitted in writing and confirmed by MOBY before the intended date of departure (also possible en route in any travel agent’s with a Moby agency). Fees will be charged, independent of whether the tickets have been issued or not. This is carried out as follows (day of cancellation will not be counted): SARDINIA-CORSICA: down to 30 days before departure: 10% of the travel price; 29 days - 48 h before departure: 20% of the travel price; from 48 hours to 1 hour before departure: 50% of the travel price. Should the person not appear or cancel at a later date a 100% fee is charged: ELBA: down to 30 days before departure: 10% of the travel price; 29 days - 10 days before departure: 20 % of the travel price. Should the person cancel later no reimbursement will be made. The ticket, however, can be used against a previous booking for a crossing to Elba during the year of issue (possible seasonal changes, etc. are calculated). No reimbursement and no claim to ticket utilisation can be granted for not appearing for the trip without previous cancellation. PEX RATES and special offer "BEST CAR": see point 6.4) LOSS OF THE TICKETThe booking office must be notified immediately of loss of a ticket or theft of a ticket. Replacement tickets may only be issued on condition that the lost ticket has not been used, a reservation has been made and the passenger can provide proof of identity. Generally € 10,00 will be charged immediately for the issue of a replacement ticket.5) BOOKING CHANGES / REIMBURSEMENTSPer each change (required in writing) after a booking confirmation has been made or after acceptance of a seat offer (also by telephone), a fee of € 10,00 is charged if not specified otherwise in the terms & conditions (in addition to the possible necessary extra charge for changes in the seasonal period, number of persons or change in vehicles). The day of the change to the reservation will not be included. Changes, if allowed, can be made up to 90 minutes before departure, however only for dates, which are stated in the current Moby brochure. within 10 days of the departure date the ticket price does not change if due to a change in season the final price of the new booking is lower than the originally reserved trip, i.e. the original value of the booking is charged. For PEX RATES and special offer "BEST CAR" see also point 6. For booking changes performed in Italy the Italian travel conditions apply. Tickets which have been changed by hand and do not have a MOBY Lines Europe stamp will not be accepted. For partial cancellations (e.g. decrease in the number of persons, cabins, etc.) fees shown at points 3 and 6 will be charged.6) PEX RATES and SPECIALOFFER "BEST CAR"are only available in limited numbers on departures in Best Price A. They can only be cancelled against 100% cancellation costs. With the special offer "BEST CAR", 100% cancellation costs will be charged on all categories/people listed in the reservation in the event of a cancellation being made. No reimbursements for not appearing for the trip/partial route. CORSICA AND SARDINIA: the tariffs can be changed for a certain fee. For each change we will charge you 10,00 € for Corsica routes and 25,00 € for Sardinia routes (plus the possible difference between the former price and a necessary higher price). ELBA: the reservation/ ticket cannot be changed. In case of cancellation, the ticket price is charged. Our special offer "Best CAR" apply exclusively to motorcycles or passenger vehicles, that is to say MOT or CARS, which are stated in our price lists as passenger cars and are only used to carry passengers. A height more than 1,86 up to 2,20m is only allowed for roof luggage. This offer does not apply to VW camper vans, minibuses, motorhomes etc. If it is established at embarkation that the vehicle is a special motor vehicle, you will be fined the difference between the special offer price and the normal tariff for cat. MBS shown in brochure.7) CHECK-INBefore boarding the ship (latest 30 minutes for passengers and 90 minutes for passengers travelling with vehicles), all passengers must check in. If the check in is not done in this requested time, we cannot guaranty the transportation.8) VEHICLES / SPECIAL CHARACTERISTICSPlease observe the specified vehicle categories and inform us about your car plate number. A) Gas-propelled vehicles must be registered extra at the time at the booking and for embarkation. B) Vehicle’s alarm systems and antitheft devices must be switched off on the ship. The driver is responsible that the hand brake is applied, a gear is putted in, the lights are switched off and the vehicle is closed by key. C) When supplying information about length and height we require the overall dimensions of the individual dimensions including possible rear or roof carriers. The car categories are valid only for sidecars or cars under a length of 1,85 m. Only with a roof baggage carrier a height over 1,85 m up to 2,20m is allowed. From 2,21 meters height, the indicated extra charge for over-height will be calculated. Vehicles like VW buses, minibuses, campers, caravans and trailers, wich are higher than 1,86m without roof baggage carrier, as written in vehicle documents, must be booked in general as special vehicles, over 2,21 meters height the extra charge for over-height is valid. In case of wrong information and / or non-compliance with the regulations you will be fined with an supply payment, it can be necessary a waiting list and the embarkation can be refused. Trucks and vehicles with more than 1500 kg of load are not considered as special vehicles but as freight vehicles. Those must be booked separately. Bicycles are transported free of charge, besides Sarcors + Elba, provided they don’t stand on a roof baggage carrier and this vehicle doesn’t exceed the total height of 2,20m. Otherwise, the raise surcharge is calculated from 2,21 m height. If you want to remove the bicycles from the vehicle´s roof, they must be accommodated lying on the roof or inside the vehicle. A stopping on board is not possible. With reference to Art. 412 and 435 of the shipping right possible vehicle damages or other events originated through our ships must be reported before the debarkation. The passenger must report the damage to a responsible officer, so that a damage form can be filled in and signed. Without this form a refund is not possible.9) PETSDogs and cats must be inoculated (Inoculation passport necessary). Please observe the entrance regulations of the countries. Dogs must kept on a lead and must wear a muzzle on board and are not allowed inside of our ships, in cabins or lounges.10) PASSENGER DETAILSIn accordance with L.D. No. 251 from October 13, 1999, and in connection with EU-Instruction 98/41 from June 18, 1998 and due to anti-terrorism regulations and the ISPS Code, we have to notify our customers of the following: ART. 4 PASSENGER INFORMATION - Each passenger requiring special help or assistance in emergency situations must make the transport enterprise aware of this fact before embarkation. All passengers must provide the following information when making reservations: surname, first name (or initial), sex, age category (baby, child, adult). Any changes in relationship to the abovementioned information which may occur between the time of reservation and the crossing must be provided immediately. The personal data will only be used during the specified times and in conformity with the EU Instruction. The traveller is liable for maintaining the entrance regulations of the individual countries, e.g. for journeys to/from Corsica a passport or identity card (even for children) is required. Costs which incur due to missing travel documents.11) BOOKING CABINS AND COACH SEATSPassengers with reservations for cabins and recliners must report immediate after embarkation to the reception desk on the ship. 90 minutes after departure, these berths will be given to passengers on the waiting list. Clients have to leave their cabins 1 hour prior to arrival.12) PORT TAXES, SURCHARGES, LOCAL TAXES AND PETROL SURCHARGESare not included in the passenger prices and will be charged extra. Changes can be made at any time up to the issuing of the ticket.13) SECURITY AND COSTS ISPSIn compliance to the international code ISPS related to the norms of anti terrorism, the passengers are informed that security controls for passports, vehicles, luggage can be done at the port or on board of our vessels. The transport enterprise points out that the costs for ISPS can be increased on behalf of the port authorities also after brochure pressure. While the ships are in the ports, is highly recommended not to get closer than 50 meters to the ships and moorings.14) EMBARKATIONAfter you have done the embarkation procedure you cannot leave the ship, neither people nor vehicles. Please take all items necessary for the crossing out of the car and with you on board as the garage decks will be closed after departure and you will not be able to access your car after that. If the ferry has separate passenger entrances, the vehicles may only be driven into/from the garages by the drivers. The passengers will enter/leave the boat via the passenger entrances.15) DECLARATION REGARDING THE VALUE OF THE VEHICLE RIDDEN INIt is pointed out, that - limited to the direct material damage to the vehicle ridden in which occurred during the transportation and due to the fault of the transport enterprise, differing from Art. 423 of the law on shipping, the „Moby“ waives the entitlement to the compensation limit of 103,29 ˛, as all other legal and contractual conditions are fulfilled that entitle a claim to compensation for such damage. This will therefore be compensated in full, without any upper limits. The waiver mentioned above makes the submission of a declaration concerning the value of the vehicle ridden in superfluous.16) CARRIAGE OF PREGNANT WOMENpossible up to and including 6 months, after which only with a doctor’s note, which must be produced on board on request. With a high-risk pregnancy a doctor’s certificate giving permission to travel is always necessary.17) CHILDREN AND YOUNG PEOPLEcan travel alone from 12 up to and including 17-years old, if a group leader accepts responsibility. Children under the age of 12 will only be allowed to travel if accompanied by an adult. When going to Corsica, minors must present valid identification papers. The transport of children under 4 years of age is included in the price. They, however, do not have the right to a seat or a cabin bed. Children from 4 years of age to 11 inclusive may travel at a 50% discount of the passenger rate (without taxes).18) VEHICLE LICENSE PLATE NODue to existing security regulations for transits to/from Olbia we have to inform the port authorities about the vehicle license plate no. of each vehicle for transits to/from Olbia. Therefore you are obliged to state this with your booking. For Elba and Corsica this is not necessary at this moment.19) ANNOUNCEMENTSRequests for refunds, complaints are required in writing and must be done within 4 weeks after departure. Reimbursements can only be applied for through the agency where the ticket was purchased and when the ticket has been certified (per route) with the date, stamp and duly signed by an agency, by Moby, the authorised port agent or paymaster within.20) LOST OBJECTSIf the passenger forgets or loses personal objects on board, he can ask at the reception of the ship. If debarkation already has taken place, the passenger can download a form from Moby’s Homepage and send it filled in by e-mail to oggetti.smarriti@moby.it. The corresponding department will employ investigations and inform over the result. The shipping company doesn’t give refunds for objects lost or forgotten on board.21) MEDICAL CAREA doctor is on board with our longer crossings, who helps in emergencies or with acute illnesses. However, s/he is not responsible for sick people, who require medical care during the journey. For this a suitable person must be taken along and a doctor's certificate presented. The carrier can refuse carriage, if an appropriate certificate is not presented to say that the journey can be undertaken or if a case of illness arises immediately before or during embarkation. Also passengers, who can be a danger to themselves and others, e.g. through non-registered illness, under the influence of alcohol, hallucinogenic etc. can be refused to embark and/or the passenger can be made liable for all damages caused to the ship, carrier or third parties.22) UPDATING GENERAL CONDITIONSAfter brochure pressure we will publish all necessary changes in internet www.mobylines.de.23) GROUPSMoby grants particular group conditions and rates. These are gladly communicated on inquiry.24) RESERVATIONSReservations for the ferries from the transport enterprise are made via MOBY Lines Europe GmbH, Wilhelmstr. 36-38, 65183 Wiesbaden or via other agents from the transport enterprise.25) JURISDICTIONMilan (Italy) has jurisdiction. Italian law is applicable.26) INSURANCEWe recommend taking out cancellation insurance of Hanse Merkur Reiseversicherung AG. Reserve directly or book on the Internet www.mobylines.de.AMI ASSISTANCE...
